Fall Storms and Fallen Trees: Who Pays for the Damage?

As the leaves change, fall storms can bring strong winds and heavy rain. If a tree comes down, one of the first questions homeowners ask is: Whose insurance pays?
The answer depends on what the tree damaged, which coverage applies, and whether anyone knew the tree was hazardous before it fell.

A tree falls on your house

Your homeowners insurance will cover damage to your home or another insured structure, such as a detached garage or fence. That can be true even when the tree grew in your neighbor’s yard. Your policy’s deductible, limits, and terms will apply.

Your tree falls on your neighbor’s house

Your neighbor would generally contact their own homeowners insurance company about damage to their home. The tree’s location alone does not automatically mean you must pay. However, if you knew the tree was dead or dangerous and failed to address it, your neighbor’s insurer may seek reimbursement from you through your liability coverage.

A tree falls on your car

A homeowners policy generally does not pay for damage to your car. That damage is typically covered by the comprehensive portion of your auto insurance, if you carry it, subject to your deductible.

A tree falls in your yard but damages nothing

Tree removal coverage varies by policy and may be limited and subject to your deductible.

What can you do before a storm?

Take a look at trees near your home, driveway, and neighboring properties. Dead branches, visible decay, or a tree that has started leaning may warrant an inspection by a qualified tree professional. Taking care of a problem early can protect your property and help prevent a difficult conversation with a neighbor later.

If a tree does fall, stay clear of downed power lines, document the damage when it is safe, and contact your insurance agent or company. Coverage always depends on your specific policy and the circumstances of the loss.
